1. Acceptance of Terms

Welcome to HEXA, a service provided by Haechon Electronics Co., Ltd. ("we", "us", "our", or "the Company"). By downloading, installing, accessing, or using the HEXA mobile application (the "App" or "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and the Company. You acknowledge that you have read, understood, and agree to be bound by all Terms, including our Privacy Policy, which is incorporated by reference.

2. Description of Service

HEXA is a social matching and dating application that incorporates traditional East Asian philosophical systems (including Saju, Bazi, and related compatibility frameworks) as one factor in its matching algorithm. The Service allows users to:

• Create a personal profile with photos, bio, and birth information.
• View and interact with other users' profiles.
• Receive compatibility-based match suggestions.
• Chat with matched users.
• Post content (photos and short videos).
• Earn points through app activities.

The Service is provided on mobile platforms (Android and iOS) and is available worldwide, subject to applicable local laws and regulations.

4. Accounts & Verification

• Phone verification: Accounts are verified via SMS OTP (one-time password). You must provide a valid phone number.
• One account per person: Creating multiple accounts is prohibited and may result in termination of all associated accounts.
• Account security: You are responsible for maintaining the confidentiality of your account and for all activities under your account.
• Accurate information: You must provide accurate registration information and keep it updated.
• Recovery email: You may provide an optional recovery email for account restoration.

5. User Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Harassment or bullying: Sending unwanted messages, threats, or abusive content to other users.
• Impersonation: Pretending to be another person or entity.
• Fraud or scams: Soliciting money, gifts, or financial information from other users.
• Prostitution or commercial sex: Using the App to facilitate commercial sex work or escort services.
• Inappropriate content: Posting nudity, sexual explicit content, violence, hate speech, or illegal activities.
• Spam: Sending unsolicited advertising, promotional material, or repetitive messages.
• Automated activity: Using bots, scripts, macros, or any automated means to interact with the App.
• Data scraping: Collecting or harvesting user data through automated means.
• Hacking: Attempting to gain unauthorized access to the App's systems, servers, or other users' accounts.
• Point abuse: Attempting to artificially inflate point earnings through fake accounts, automated actions, or any other manipulation.
• Underage use: Using the App if you are under 18 years old.
• Violation of laws: Using the App in violation of any applicable law or regulation.

Violations may result in content removal, point forfeiture, account suspension, or permanent ban, at our sole discretion. We reserve the right to report illegal activities to law enforcement authorities.

6. User-Generated Content

6.1 Your Responsibility

You are solely responsible for all content you post or share on HEXA, including profile photos, posts, short videos, bio text, and chat messages. You represent that you have all necessary rights to post such content and that it does not violate any law or third-party rights.

6.2 Content License

By posting content on HEXA, you grant the Company a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute your content within the Service for the purpose of operating and promoting the App. This license terminates when you delete the content or your account.

6.3 Content Moderation

We reserve the right to review, modify, or remove any content that we believe violates these Terms or is otherwise objectionable. We do not pre-screen all user content, but we act on reports from users and automated detection systems.

6.4 Reporting

You can report inappropriate content or users through the in-app reporting feature. We will investigate reports and take appropriate action.

7. Matching & Compatibility

8.1 How Points Are Earned

• Daily login: 5 points
• Sending a like: 1 point
• Sending a chat message: 2 points
• Successful match: 10 points
• Receiving a paid message: 20 points
• Profile completion (one-time): 50 points

8.2 Point Value & Limits

• Conversion rate: 10 points = 1 KRW (0.1 KRW per point), subject to change.
• Daily earning limit: 100 points per day per user.
• Points are non-transferable between users and cannot be exchanged between accounts.

8.3 Withdrawal

8.4 Point Forfeiture

• Points earned through fraudulent means or point abuse will be forfeited.
• Accounts terminated for violations will forfeit all accumulated points.
• Points are forfeited upon account deletion.

9. Advertising

The Service is supported by advertising through Google AdMob. Ads may appear as banners, native placements, or interstitials. By using the App, you acknowledge that:

• Ads are served by Google AdMob and may be personalized based on device identifiers.
• We do not control the content of third-party advertisements.
• We are not responsible for the products or services advertised.
• Points are not awarded for viewing or clicking ads, in compliance with Google AdMob policies.
• You can manage ad personalization through your device settings.

10. In-App Purchases & Subscriptions

HEXA may offer optional in-app purchases, including but not limited to:

• Premium messages: Send messages to users you have not matched with.
• HEXA Premium subscription: Access to enhanced features.
• Other features: Additional purchasable items as introduced.

10.1 Purchase Terms

• All purchases are processed through Google Play Store (Android) or Apple App Store (iOS).
• Payment and refund policies are governed by the respective platform's terms.
• Subscription auto-renews unless cancelled at least 24 hours before the renewal date.
• Prices may vary by region and are displayed in your local currency at the time of purchase.
• All purchases are final and non-refundable except as required by applicable law or platform policy.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you agree to the data practices described in the Privacy Policy.

12. Intellectual Property

12.1 Company Ownership

The App, including its design, features, matching algorithm, branding, and all associated intellectual property, is owned by Haechon Electronics Co., Ltd. and is protected by copyright, trademark, and other applicable laws.

12.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App.
• Reverse engineer or decompile the App.
• Use the App's content for commercial purposes without authorization.
• Remove or alter any proprietary notices.

13. Disclaimers & Limitation of Liability

13.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13.2 No Guarantee of Results

• We do not guarantee that you will find a match, relationship, or any specific outcome.
• Compatibility scores are algorithmic estimates and not professional advice.
• We do not guarantee uninterrupted or error-free service.
• We are not responsible for the conduct of other users.

13.3 Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

The Company's total liability for any claim shall not exceed the amount you have paid to the Company in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

13.4 User Interactions

The Company is not a party to any interactions between users and is not responsible for the conduct of any user on or off the Service. You are solely responsible for your interactions with other users and for exercising caution when meeting other users in person.

14. Account Termination

14.1 Voluntary Termination

You may delete your account at any time through the App settings or by contacting support@haechon.one. Account deletion is permanent and irreversible.

14.2 Termination by the Company

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, including but not limited to:

• Violation of these Terms.
• Fraudulent activity or point abuse.
• Underage registration.
• Repeated reports from other users.
• Legal requirements or government requests.

14.3 Effect of Termination

• All points are forfeited upon termination.
• Premium subscriptions remain subject to platform refund policies.
• Profile and content are deleted within 30 days.
• Certain data may be retained as described in the Privacy Policy.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.

15.2 Dispute Resolution

• Negotiation: Parties shall first attempt to resolve disputes through good-faith negotiation.
• Mediation: If negotiation fails, parties shall attempt mediation before arbitration.
• Arbitration: Unresolved disputes shall be submitted to arbitration in Seoul, Korea, under the rules of the Korean Commercial Arbitration Board (KCAB).
• Class action waiver: You agree that disputes will be resolved individually and not as part of a class action.

15.3 Jurisdiction-Specific Rights

Some jurisdictions do not allow certain limitations or waivers. If you are a consumer in the EEA, UK, or other jurisdiction with mandatory consumer protection laws, you retain all rights granted by those laws, and this section does not override them.

16. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via in-app notification or email at least 30 days before the changes take effect. The "Last updated" date at the top of this page indicates the most recent revision.

Continued use of the App after the effective date constitutes acceptance of the updated Terms.
